§ 1. scope of application
Orders placed via our online bicycle accessories store https://www.convoy-products.de are subject exclusively to these GTC in the version applicable at the time of the order.
Deviating general terms and conditions of the customer are rejected.
They shall only become effective if they are expressly confirmed by us in writing.
§ Contractual partner
The purchase contract is concluded with Punta Velo GmbH, Lippestraße 13, D-46282 Dorsten, commercial register: Amtsgericht Gelsenkirchen HRB 10511.

§ Conclusion of the contract, order text, minimum order value
The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to order.
By clicking on the “Buy” or “Buy now” button, you place a binding order for the goods contained in the shopping cart.
Confirmation of receipt of the order follows immediately after the order has been sent and does not constitute acceptance of your offer.
The purchase contract is concluded when we accept your order by sending an order confirmation by e-mail or by delivering the goods within 14 days.

§ 4. contract language

If you order from abroad, we currently only have the contract language German available.
§ 5 Right of withdrawal
5.1 Consumers have the right to withdraw from this contract within fourteen days without giving any reason. In the case of a contract for the purchase of one item, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the item. In the case of a purchase contract for several goods, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. 5.2 Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment fees for the pure repayment transfer. You must pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
5.3 Exclusion/expiry of the right of withdrawal
The right of withdrawal does not apply to the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, nor to the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.
§ 6 Prices, shipping costs
6.1 Prices
All prices are quoted in euros and include the currently applicable statutory value added tax of the Federal Republic of Germany: VAT full 19% or VAT reduced 7%.
6.2 Shipping costs
In addition to the stated prices, we charge shipping costs.
We ship our products within Germany and to the following countries: Spain without islands, Belgium, the Netherlands, France, Sweden, Denmark, Austria and Portugal.
Your shipping costs depend on the size, weight, nature and quantity of the goods ordered in your order.
For individual orders within Germany, this is a maximum of €99.
Deliveries to countries other than those specified will only be made on request at the agreed delivery costs.
§ 7 Shipping
7.1 Delivery shall be made to the delivery address specified by the customer.
If the customer is a consumer, the risk of damage and accidental loss of the goods shall pass to the customer as soon as the goods are handed over to him.
If the customer is an entrepreneur (§ 14 BGB), the risk of damage and accidental loss of the goods shall pass to the customer as soon as the goods are handed over by Punta Velo GmbH to the transport company (§ 447 BGB).
If the customer is in default of acceptance, this shall be deemed equivalent to receipt of the goods by the customer.
7.2 In the case of forwarding deliveries, we reserve the right to determine the choice of packaging at our own discretion and to ship in a way that optimizes shipping.
This applies in particular to larger deliveries (entire truckloads) where, due to the quantity, shipping on pallets would mean that an additional truck would be necessary.
7.3 If the customer is a merchant, the goods must be inspected for transport damage immediately upon receipt by the customer or his authorized representative.
Any ascertainable transport damage must be reported immediately in writing.
The customer who is a merchant must have packaging damage confirmed in writing by the transport company upon acceptance of the goods.
§ 8 Retention of title, due date
The goods remain our property until full payment has been made.
The ordered goods must be paid for immediately after receipt of our declaration of acceptance, currently by bank transfer to our business account, other payment methods will follow.
If a voucher is redeemed for payment, you bear the risk of receipt of the voucher by us.
We therefore strongly recommend sending the goods by registered mail.
§ 9 Designation/description of our goods
9.1 Weight specifications, geometries,

The stated deviations correspond to an equivalent service in terms of quality and price.
If we sell third-party goods, slight deviations of the original from the illustration are possible for technical reasons.
9.3 The information on technical specifications, properties and technical equipment components and their components from third-party manufacturers is non-binding; deviations are possible at any time.
9.4 The color specifications, information on technical properties and technical functionality of bicycle accessories, in particular goods from third-party manufacturers, are generally non-binding.
9.5 The maintenance and care instructions for Punta Velo goods must be observed
§ 10 Guarantee / Warranty
10.1 Punta Velo GmbH grants a 2-year manufacturer’s warranty on all components, excluding/only tires and casings as well as all consumables such as brake discs or brake pads.
Damage caused by incorrect or faulty use is not covered by the warranty. The warranty/guarantee covers the repair and, in individual cases, the replacement of parts.
10.2 Manufacturer warranties and dealer warranties
All expressly stated warranties are manufacturer or additional dealer warranties; the type of warranty is stated on the product in each case.
Wear and tear (except where this is expressly stated on the product) and improper use do not entitle the user to make a claim under these additional manufacturer or dealer warranties.
To make a claim under the guarantees, please contact us first.
§ 11 Transport damage/complaints
Please notify us immediately of any obvious defects.
If a parcel arrives visibly damaged, please open it immediately in the presence of the postman/parcel service and have a damage certificate issued immediately.
Otherwise it will be assumed that the damage was not present at the time of delivery.
Failure to immediately report a defect or to open the parcel in the presence of the postman/parcel service has no consequences for your statutory warranty rights.

§ 12 Publications
Punta Velo is expressly permitted by the customer to include and publish project descriptions, product photos and illustrations of the products delivered to the customer and, if applicable, individualized for the customer at his own request, as well as their project presentations and descriptions in the reference list on the websites operated by Punta Velo, on social media platforms currently popular at the time of the order and on printed advertising material of Punta Velo GmbH, as well as to publish these in the form of press releases to the public.

Insofar as this website contains external links (hyperlinks) to third-party websites, these linked websites are the sole responsibility of the respective operator.
Punta Velo GmbH has no influence on the content of the linked target pages, so that Punta Velo GmbH expressly does not adopt the content of the linked pages as its own.

§ 14 Choice of law & place of jurisdiction
German law shall apply.
The place of jurisdiction is Dorsten / Essen.
§ 15 Severability clause
Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
